Ola HyperService ('HyperService')- Terms & Conditions
1. Nature of HyperService
HyperService™ is a service experience framework intended to improve transparency, communication, and turnaround times for vehicle servicing. HyperService™ does not constitute a guarantee of repair, replacement, or delivery within any fixed time period, except as expressly stated herein.
HyperService™ does not alter or replace Ola's standard service policies, warranty terms, or statutory obligations.
2. Meaning of "Same-Day Service"
For the purposes of HyperService™:
- "Same-day" refers strictly to the same calendar day on which the vehicle is checked in at the HyperService Centre.
- Same-day service does not imply:
- A fixed turnaround time
- Express or priority service
- Continuous work without interruption
- Actual service timelines depend on multiple factors, including but not limited to vehicle condition, diagnostics required, approvals, safety checks, and availability of parts.
3. Scope of the HyperService Commitment
Subject to eligibility and exclusions, Ola will make commercially reasonable efforts to achieve one of the following outcomes on the same day as check-in:
- Completion of diagnosis and repair; or
- Completion of diagnosis with a clearly communicated resolution plan and estimated timeline; or
- Communication of constraints preventing completion of the above, along with appropriate next steps.
HyperService™ does not guarantee that all vehicles or issues will be repaired on the same day.
4. Eligibility Determination
Eligibility for HyperService™ is determined solely by Ola at the time of inspection and is subject to:
- Vehicle condition
- Nature and complexity of the issue
- Safety considerations
- Availability of parts, tools, and personnel
- Accuracy and completeness of customer disclosures
Ola's determination of eligibility shall be final.
5. Exclusions and Limitations
Same-day repair may not be possible in cases including, but not limited to:
- Accident, fire, or flood-damaged vehicles
- Structural or frame damage
- Battery replacements requiring factory or regulatory approval
- Complex or intermittent electrical or software issues
- Vehicles with unauthorised modifications
- Insurance or third-party approval cases
- Non-availability of required spare parts
- Issues requiring extended observation or testing
In such cases, Ola's obligation is limited to diagnosis and communication of next steps, where reasonably possible.
6. Customer Responsibilities
Customers are responsible for:
- Providing accurate and complete information regarding the issue
- Arriving on time for the scheduled appointment
- Providing timely approvals for chargeable work
- Remaining reachable during the service process
Delays or failures caused by inaccurate disclosures, late arrival, or delayed approvals may impact service timelines and eligibility.
7. Pricing and Payments
HyperService™ does not carry a separate service fee.
All labour charges, spare-part prices, and taxes are applicable as per Ola's standard pricing.
Any chargeable work will be undertaken only after customer approval.
8. No Automatic Compensation
HyperService™ does not provide any automatic right to compensation, refund, replacement vehicle, or damages for delays.
Any goodwill gesture, service credit, or remedy, if offered, shall be:
- At Ola's sole discretion
- Without admission of liability
- Non-precedential
9. Limitation of Liability
To the maximum extent permitted by law, Ola shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to service delays.
Ola shall not be liable for delays or non-performance caused by events beyond its reasonable control, including force majeure events, regulatory actions, supply-chain disruptions, system outages, or safety-related holds.
10. No Waiver of Statutory Rights
Nothing in these Terms limits or waives any non-excludable rights available to customers under applicable consumer protection laws. Where statutory obligations apply, Ola's liability shall be limited to the minimum extent required by law.
11. Modification or Withdrawal
Ola reserves the right to modify, suspend, or withdraw HyperService™ or any of its features at any time without prior notice.Continued use of HyperService™ constitutes acceptance of the updated terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India and the Courts at Bengaluru shall have exclusive jurisdiction.
13. Interpretation
Headings are for convenience only and shall not affect interpretation. Any ambiguity shall be interpreted in a manner consistent with applicable law and Ola's standard service policies.
